Jason H. Rubens
Jason H. Rubens is the owner of the firm. Mr. Rubens graduated from the University of Arizona Honors Program and also graduated cum laude in 1992. He received a dean’s scholarship to the DePaul University College of Law and graduated in 1995.
Mr. Rubens has practiced law since November of 1995. Initially he worked for a small workers compensation firm. Following that he worked for one of the largest insurance companies in the world for about four years. He attributes a good deal of his success representing injured clients to the experience he obtained working for the defense side. In an interview he was quoted as stating: “I know how they think and what strategies they employ to attempt to minimize the value of a claim”.
In September of 2001 Mr. Rubens opened his own firm. Since that time the firm has grown to a four-attorney firm on the often forgotten principle that the lawyer works for the client and the client is the one that pays his bills. Mr. Rubens has had several jury trials. Each one was successful. This means that in each of his plaintiff jury trials he has beaten the offer made by the insurance company. In his sole defense trial he obtained a not guilty verdict. Mr. Rubens has vast experience in handling workers compensation cases. He has tried dozens of workers compensation cases and has argued many appeals.
He has made significant new law (on the winning side) in several workers compensation cases. He has a rare case on the issue of res judicata and collateral estoppel concerning what issues can be litigated in a workers compensation case that have already been litigated in a third party case. In another noteworthy case, Mr. Rubens successfully represented a client who was a traveling employee and had an Arbitrator’s decision denying compensation reversed. He successfully argued that traveling employees are afforded greater protection underthe Illinois Workers Compensation Act.
Mr. Rubens most notable influence on Illinois Workers Compensation law is the case of United Airlines v. Workers Compensation Commission (Mahoney). In that case Mr. Rubens obtained a reversal of fifteen years of law in a unanimous decision by the Illinois Supreme Court finding that if an injured worker was hired in the State of Illinois he has the right to file an Illinois Workers Compensation claim regardless of where he was injured. This case was cited as the third most influential workers compensation case in Illinois in the past ten years in a recent article. Mr. Rubens commented on this decision by stating, “The Mahoney decision illustrates the fundamental fairness of the workers compensation system in Illinois. It shows that the courts follow the law and are not influenced by big corporations. It is a huge victory for the little guy”.
Frank D. Kress
Frank D. Kress completed his undergraduate studies at the University of Michigan. Mr. Kress received his law degree from DePaul University. He became licensed to practice law in Illinois in 2004.
Mr. Kress practices almost exclusively in the field of workers compensation law. He has tried numerous workers compensation cases and argued several appeals including an appeal before the First District Appellate Court. Mr. Kress has made significant new law (indicating success for the injured worker) on the issue of whether a worker is considered an employee or an independent contractor. He has successfully represented many clients with career ending injuries. Previously Mr. Kress gained litigation experience representing the rights of hospitals in the Virginia area.
Toby P. Mulholland
Toby P. Mulholland dedicates his entire practice to helping those who have been seriously injured. He concentrates in automobile accidents, construction negligence cases, premises liability, wrongful death and other areas. After receiving his degree in Finance from the University of Iowa, Mr. Mulholland received his Juris Doctor degree from DePaul University. He has been licensed to practice law since 2000 and ever since, he has been a personal injury attorney helping accident victims of all ages obtain fair and just compensation for their injuries.
Mr. Mulholland has vast litigation and court experience, including taking countless depositions, and participating in several jury trials, arbitrations and mediations, which have resulted in successful outcomes for his clients. Mr. Mulholland is also a certified arbitrator for the Circuit Court of Cook County, Illinois.
Robert B. Pawlowski
Robert B. Pawlowski received his undergraduate degree in English and Psychology from the University of Michigan. After graduating from the University of Michigan, Mr. Pawlowski received his Juris Doctorate degree from Thomas M. Cooley Law School and was admitted to the Illinois Bar in November of 2007.
Mr. Pawlowski has helped numerous clients file personal bankruptcies under Chapter 7 and Chapter 13 of the bankruptcy code as an associate at a large bankruptcy firm. Since leaving the bankruptcy field, Mr. Pawlowski has focused his legal practice solely in the area of civil litigation involving workers compensation and serious personal injury claims.
Mr. Pawlowski has handled cases involving workplace accidents, automobile accidents, and construction negligence cases, in addition to other negligent acts resulting in bodily injury. Mr. Pawlowski works diligently to aggressively represent the legal interests of his clients and obtain full compensation for their damages.
